MOTION TO SUPPLEMENT DEFENDANT'S CLOSING ARGUMENT BINDER WITH PLAINTIFF'S COMPLAINT IN THIS CASE Pursuant to Rule 7(b) of the RCFC, defendant, the United States, respectfully requests to supplement defendant's closing argument binder with plaintiff's complaint. Attached for the Court's convenience is a replacement binder that includes plaintiff's complaint. Closing argument took place on March 7, 2007. At closing argument, each party submitted to the Court a binder containing certain documents pertinent to that party's closing argument. For the reasons set forth below, defendant requests to supplement its closing argument binder with plaintiff's complaint. Plaintiff's complaint, of course, is a part of the record. The closing argument binders simply collect the relevant parts of the record in one place for the Court's convenience. During closing argument, the parties disagreed as to whether securitization, recourse removal, and the cessation of dividends were caused by the breach. We argued that, if these actions were not caused by the breach, there would have been no conceivable reason for Mr. Rutland, Northeast's former Chief Executive Officer, to describe these actions, and detail the amount of the costs associated with these actions, in his affidavit submitted in support of Northeast's breach of contract claim. Plaintiff did not respond to our argument concerning Mr.

Rutland's description of these actions in his affidavit. We presume that plaintiff's argument is that, since Mr. Rutland is deceased, Northeast does not know why he included such items in his affidavit. We move to include plaintiff's complaint as part of our closing argument binder because of the similarities between the allegations contained in the complaint and Mr. Rutland's affidavit. Specifically, we note that Northeast's complaint in this case also specifies that it securitized its loans and removed recourse and details the costs of these actions. Northeast's Complaint at ¶¶ 105, 106. The Complaint also describes Northeast's cessation of dividends. ¶105. During oral argument the Court inquired as to the relationship between the breach, i.e. the phase-out of goodwill, and the risk-based capital requirements. Plaintiff's complaint also addresses this point. See, e.g., ¶¶ 92 ,93, 110. Therefore, for the above-stated reasons, we respectfully request that our closing argument binder be supplemented to include plaintiff's complaint. Respectfully submitted, MICHAEL F.
