No. 07-582C (Consolidated Lead Case)

Senior Judge James F. Merow

No. 07-695C (Consolidated Member Case)

PLAINTIFF'S MOTION FOR LEAVE TO EXCEED PAGE LIMIT Pursuant to RCFC 5.2(b)(1) and RCFC 7, Plaintiff Infrastructure Defense Technologies, LLC ("IDT"), through the undersigned counsel, respectfully requests leave from the Court to exceed by 6 pages the page limit set forth in this Court's rules for the filing of IDT's Motion For Judgment On The Administrative Record and brief in support thereof.

Leave to exceed the page limit is necessary because RCFC 5.2(b)(1) limits a part's initial brief or memorandum to 40 pages. Because there are two protests in the consolidated actions, and IDT's brief addresses factual and legal matters in both protests, this Court's 40-page limit (which IDT respectfully submits was intended to cover briefs and memoranda prepared for one case only) will not be sufficient. Thus, IDT respectfully requests leave from the Court to exceed the page limit set forth in RCFC 5.2(b)(1) by 6 pages.
