In the Joint Status Report (JSR) filed on August 1, 2007, the parties requested that they be allowed more time to enable the Defendant to review the Court's ruling and decide whether to ask the Court to certify an interlocutory appeal to the U.S. Court of Appeals for the Federal Circuit, pursuant to 28 U.S.C. Section 1292(d)(2). The parties would submit a further JSR once a decision is made, but no later than October 1, 2007. The Court requests that the parties file a formal motion regarding the above request forthwith. IT IS SO ORDERED.
