JOINT NOTICE OF RECENT COURT DECISION PLEASE TAKE NOTICE that, on June 25, 2007, the Honorable Walker D. Miller of the District Court of Colorado issued an opinion in Genesis Insurance Co. v. Crowley, et al., Civil Action No. 05-335 (the "Colorado action"). On June 22, 2007, Defendant, Daniel Crowley, filed a motion and opening brief seeking to continue the trial date in the above-captioned action from the currently-scheduled date of September 17, 2007. The Trustee intends to oppose Defendant's motion to continue the trial date and will file his opposition on or before July 12, 2007.
