The Intervening Plaintiffs move for an amendment to the Privacy Act Protective Order filed May 5, 2006. The requested amendment would allow disclosure of the protected material to counsel of Intervening Plaintiffs. BACKGROUND Plaintiffs moved for a list to be provided by Defendant of individuals who may be 1886 descendants. Plaintiffs' motion was granted. However, the material to be provided by Defendant may include information protected by the Privacy Act, 5 U.S.C. ยง 552a. Therefore, the Court issued an Order to ensure that the distribution of the material would not violate the Privacy Act. The Order allowed the material to be disclosed only to Plaintiffs' counsel, co-counsel and staff, and Plaintiffs' consultants.

Since the issuance of the Order, numerous individuals have intervened in this litigation. All counsel representing intervening plaintiffs and Ms. Felix, pro se want to review the material. The undersigned counsel for intervening plaintiffs consulted with counsel for the United States. Counsel for the United States has authorized undersigned counsel to state that Defendant consents to the entry of the attached [Proposed] Modification of Privacy Act Protective Order.
