(Senior Judge Margolis)

UNITED STATES,
Defendant.

PLAINTIFF' S OPPOSITION TO DEFENDANT' MOTION FOR AN ENGLARGEMENT OF TIME
The Plaintiff US. Financial Corporation ("US. Financial") opposes the Defendant's
Motion for Enlargement of Time. Although the Defendant' s

counsel is busy, the Plaintiff is

entitled to have this case adjudicated as expeditiously and economically as possible.

The Complaint was filed on March 20 2003. The Defendant was granted four extensions
oftime through September 2

2003 , to file its Answer. Plaintiffs Motion for Summary

Judgment was filed on September 9, 2003. The Defendant had thirty days to respond, until
October 10

2003. The Defendant waited until the last day to respond to seek an enlargement of

time. The Plaintiffs Motion is based upon the Defendant' s admissions in its Answers and ThirdParty Complaint. The Defendant's Motion for Enlargement of Time does not challenge the

Plaintiffs Motion , and the Plaintiffs Motion should be granted without further delay.
Respectfully submitted
