On December 23, 2004, American Power Conversion Corporation ("APC") flied a
compiaint for patent infringement of U.S. Patent No. 4,823,247 inthe instant action against Eaton
Power Quality Corporation (“IiEPQ"). On January 26, 2005, EPQ tiled a motion to dismiss this
action.
APC and EPQ have entered into a settlement agreement resolving the claims asserted by
APC against EPQ. Pursuant to Federal Ruie of Civil Procedure 41, Plaintiff APC and Defendant
EPQ, HEREBY STIPULATE ANI) AGREE, by and through their counsel of record, to the
dismissal with prejudice of all claims, affirmative defenses and counterclaims, if any.
This stipulation is made in accordance with the parties’ executed settlement agreement.
Each party to bear its own costs and attomeysf fees.
