STIPULATED ORDER OF DISMISSAL
Plaintiff E., I. du Pont Nemours and Company ("DuPont") commenced this action by
the filing of a Complaint against defendants Bed Bath 84: Beyond Inc. ("Bed Bath &
Beyond"} and Shen Manufacturing Company Incorporated d/b/a John Ritzenthaler
Company ("RitzenthaIer") on December 22, 2004 alteging that defendants have engaged in
acts of trademark infringement, unfair competition and other related causes ofaction under
federal, state and common law arising frorn the use by defendants ofthe DUPONT`,
NOMEX and KEVLAR trademarks on product packaging for a glove product sold by
defendants as shown in Exhibit 1.
Now, pursuant to a settlement agreement entered into by the parties hereto, and to
the stipulation ofplaintiff DuPont and defendants Bed Bath & Beyond and Ritzenthaier,
and subject to the approval of this Court, it is hereby ORDERED, ADIUDGED AND
DECREED that:

l. Defendants shall immediately and permanently cease and be enjoined from the
manufacture, distribution, display and use ofthe packaging depicted in Exhibit l ("Product
Packaging").
2. Notwithstanding the above, defendant Bed Bath & Beyond may continue to sell,
offer for sale and display those glove products in its current product inventory that were
originally packaged in the Product Packaging until said current inventory is exhausted.
3.. Defendants consent to the entry of this order with no admission by Defendants of
any liability or any violation oflaw,
4.. This Court has jurisdiction ofover the parties and the subject matter ofthis actions
5. All parties shall bear their own costs and expenses
