GOVERNMENT'S PROPOSED JUROR QUESTIONNAIRE
TO THE PROSPECTIVE JUROR: You have been summoned as a prospective juror in the case of United States of America v. William Sablan. Mr. Sablan is charged with Murder in the First Degree of Joey Estrella. Mr. Sablan has pled not guilty and is presumed to be innocent. The trial is scheduled to start on or about January 22, 2007 and it is expected to last approximately ______ weeks. The jury selection process is expected to take about fourteen (14) days. Those selected as members of the jury will live at home and have their evenings, weekends, and generally one weekday per week free. AS A POTENTIAL JUROR YOUARE REQUIRED BY LAW TO COMPLETE THIS QUESTIONNAIRE REGARDLESS OF ANY PROBLEMS THAT YOU MAY HAVE SERVING AS A JUROR IN THIS CASE. After a jury has been selected, all copies of your response to this questionnaire will be returned to the Clerk of the Court and kept in confidence, under seal. The purpose of these questions is not to ask unnecessarily about your personal matters. It is solely to determine whether a prospective juror can decide this criminal case fairly, objectively, and impartially. Answer each question below as completely and as accurately as you reasonably can. Remember that there are no right or wrong answers, only complete and incomplete answers. The only thing that matters is that your answers are truthful. Your

complete written answers will save a great deal of time for the Judge, for the lawyers, and for you. Print your answers and use ink only. V.

DEATH PENALTY CONSIDERATION OF THE DEATH PENALTY The following questions concern your feelings, attitudes, opinions, and beliefs about the

death penalty. The court is asking these questions regarding your feelings about the death penalty because the death penalty is one of the possible sentences for a person convicted of certain of the charge contained in the indictment. The other possible punishment is life in prison without the possibility of release. Therefore, the court must know whether you will be fair to both the government and to the defendant on the issue of punishment, if you reach that issue. The court will now explain to you a little more about this case and the procedures that will be used. The case may proceed in two stages. During the first stage of the trial, the jury will determine whether the defendant is guilty or not guilty of the offense charged in the indictment. If the defendant is found guilty of an offense for which the death penalty may be imposed, the court will conduct a separate sentencing hearing to determine the punishment to be imposed. At the separate sentencing hearing, the jury will be instructed to consider certain aggravating factors offered by the United States. At the separate sentencing hearing, the jury will also be instructed to consider mitigating factors offered by the defendant. The word "aggravate" means to "make worse" or to "intensify." An aggravating factor, then, is a fact or circumstance which would tend to support imposition of the death penalty. The word "mitigate" means to "make less severe" or to "moderate." A mitigating factor, then, is: any aspect of the defendant's background, character, or record; any circumstance of the 15

offense(s); or any other relevant fact or circumstance which would tend to support imposition of a sentence of life imprisonment without the possibility of release. After considering and weighing the aggravating and mitigating factors at the sentencing hearing, the jury will be asked to make a decision whether the defendant should be sentenced to death or to life imprisonment without possibility of release. The jury's decision will be made on the basis of the evidence presented and the Court's instructions on the law applicable to this case. The Court will sentence the defendant according to the decision of the jury. In any case in which the charge carries a possible penalty of death, the law requires that jurors answer questions regarding their views, beliefs, and opinions about the possible penalties. This is true even though the defendant might be found not guilty of the charge in the indictment, and thus, the trial might not reach the second stage.
