DANIEL A status conference is set in this matter for Wednesday, September 20, 2006, at 3:00 p.m. to discuss and decide important pretrial scheduling issues. Specifically, the issues that will be addressed at the conference include: (1) whether additional motions will be filed, such as motions in limine, other motions challenging the admission of evidence at trial, motions regarding expert or lay testimony or any other motions regarding the trial or trial procedure, and what those motions will be; (2) the time frame as to when such motions will be heard; (3) whether other issues will need to be resolved prior to trial (with the exception of the issues and motions that are set to be heard the week of November 6, 2006); (4) the approximate number of fact and expert witnesses that each side will present at both the guilt phase and the penalty phase of the trial; (5) the length of jury selection and voir dire given that this is a capital case; (6) the need for a jury questionnaire; (7) how challenges to jurors should be handled; (8) the jury instructions to be given at both the guilt phase and penalty phase and the anticipated time frame needed to address those instructions; (9) the length of both the guilt phase and the penalty phase of the trial; (10) whether the parties anticipate the penalty phase commencing immediately after the guilt phase or whether there should be a break in between the two phases; (11) related to the prior issue-- whether the parties anticipate that motions will be filed or issues raised after the guilt phase that may impact the commencement of the penalty phase; and (12) how the trial schedule will be set each week.
