Hoang, Hieu T. Van, Gregory Storbakken, Joan Storbakken, Allan Walts and Marsha Walts (collectively, the "Homeowners"), by and through their respective counsel, hereby submit the following Joint Status Report to update the Court, as requested by Order dated September 21, 2005. 1. This Action was stayed in favor of two actions pending in the Jefferson County

District Court, State of Colorado: (1) the garnishment proceeding initiated by the Homeowners against Assurance styled, Hoang, et al v. Arapahoe Drain Systems, Inc., et al, Civil Action No.

99CV2425 (the "Garnishment Proceeding"); and (2) the Third-Party Complaint filed by Monterra against Assurance, styled Monterra Homes (Powderhorn), LLC, et al v. Assurance Company of America, Civil Action No. 01CV2344 (the "Third-Party Action"). 2. Assurance and Maryland filed a Notice of Appeal (the "Appeal") with the

Colorado Court of Appeals challenging the judgment entered against them in the Garnishment Proceeding. The Appeal was consolidated with the appeal of the judgment entered on the Homeowners' Verified Bill of Costs, including expenses and statement of attorneys' fees, entered on January 7, 2003. 3. The Third-Party Action is currently stayed pending full and final resolution of

appeal of the Garnishment Proceeding. 4. On February 24, 2005, the Court of Appeals issued its opinion in the Garnishment

Proceeding. The Court of Appeals affirmed in part and reversed in part the trial court's decision, and remanded the case to the trial court for further proceeding consistent with its opinion. 5. On June 2, 2005, the Homeowners and Monterra each filed Petitions for Writ of

Certiorari with the Colorado Supreme Court. The Petitions were assigned case number 05 SC 389. 6. Certiorari. 7. The Petitions and Cross-Petition have not been ruled upon by the Colorado On July 8, 2005, the Assurance and Maryland filed a Cross-Petition for Writ of

Supreme Court.
