We represent Hitachi, Ltd., Hitachi Displays, Ltd., lelitachi Display Devices, Ltd.,
and Hitachi Electronic Devices (USA) (collectively “l-Iitachi") in the above—ret`erenced matter.
We write with reference to the March 8 submission ofthe Joint Proposed Scheduling Order and
in anticipation ofthe upcoming hearing on March 13 of Matsushita’s January 9 motion for a
clarification relating to the stay of customer defendants.
Hitachi and Honeywell have been engaged in good—faith negotiations regarding the
possible stays of one or more ofthe Hitachi defendants. During the negotiations the parties
recently reached an impasse. Both sides agreed, however, that the outcome ofthe March 13
hearing will likely provide sufficient guidance that will allow the parties to finalize their
agreement. However, inthe event that the Court’s determinations relating to Matsushita’s
xnotion to stay and/or the Court’s views on issues raised in the text of the proposed order do not
sufficiently resolve l·Iitachi~specitic issues, a motion to stay one or more ofthe Hitachi entities
may be forthcoming.
