2006 , and was advised that Mr. Gruppuso does not oppose Defendants ' Joint Motion for Leave

to Depose Mr. Vito B. Gruppuso (Docket Entry No. 651). Counsel for First Capital was further
advised that Mr. Gruppuso plans to appear for his deposition in this matter if it is properly
noticed , subject to any requirements imposed by the Federal Bureau of Prisons as a result of his
