Pursuant to D.C.COLO.LCivR 7.1(E), Defendants submit the following supplemental authority in support of their Motion for Summary Judgment Based on the Unprotectability of Plaintiff's Barbwire Jewelry Under the Copyright Laws: Satava v. Lowry, 323 F.3d 805 (9th Cir.), cert denied, 540 U.S. 983 (2003) (copy attached as Tab A). The Satava case was published after the Defendants' submitted their briefs in support of their motion for summary judgment. This case directly addresses the issues raised in Defendants' Motion for Summary Judgment, as well as many of the issues raised by the Court in its Minute Order setting this matter for oral argument on July 15, 2005.
