WOLOK ______________________________________________________________________________ COME NOW the Plaintiffs by and through their attorneys, Dill Dill Carr Stonbraker & Hutchings, P.C., and, pursuant to Fed. R. Civ. P. 41(a)(2), move that the claims pending in this action against Mark E. Wolok be dismissed with prejudice and, in support thereof, state as follows: 1. On February 13, 2007, Mark Wolok filed a Chapter 7 bankruptcy proceeding in

the United States Bankruptcy Court for the Eastern District of Michigan, Case No. 07-42830-pjs. On July 27, 2007, the Plaintiffs herein filed an adversary case in the Mark Wolok bankruptcy proceeding, which was given Case No. 07-6045-pjs, pursuant to which Plaintiffs therein

contested the dischargeability by Defendant Mark Wolok of the claims pending in the abovecaptioned action. 2. On December 3, 2007, the United States Bankruptcy Court for the Eastern District

of Michigan entered an Order Excepting Debt from Discharge and Dismissal of Action pursuant to which such court entered judgment in the amount of $5,000,000 in favor of the Plaintiffs herein and against Defendant Mark Wolok and determined such judgment to be nondischargeable and excepted from the discharge in the Chapter 7 bankruptcy proceedings of Mark Wolok. A copy of the Order Excepting Debt from Discharge and Dismissal of Action is attached hereto as Exhibit A. 3. The Order Excepting Debt from Discharge and Dismissal of Action in which the

$5,000,000 judgment was entered in favor of Plaintiffs herein and against Mark Wolok fully resolves the Plaintiffs' claims herein against Defendant Mark Wolok. 4. Pursuant to Paragraph 2 of the Order Excepting Debt from Discharge and

Dismissal of Action, Plaintiffs herein are ordered to dismiss their claims in the above-captioned action against Mark Wolok with prejudice. WHEREFORE, for the reasons stated herein, Plaintiffs respectfully request that this Court dismiss with prejudice the claims pending in the above-captioned action against Mark Wolok.
