SUPPLEMENT TO FOURTH MOTION FOR EXTENSION OF TIME TO FILE RESPONSE TO MOTION FOR SUMMARY JUDGMENT Defendant Jamie Goldstein respectfully submits this Supplement to Fourth Motion for Extension of Time to File Respond Plaintiff's to Motion for Summary Judgment and states as follows: 1. On January 23, 2006, Mr. Goldstein filed a Fourth Motion for Extension of Time

to File Response to Motion for Summary Judgment (the "Fourth Motion"). 2. In Mr. Goldstein's Rule 7.1 Certification, counsel stated that he learned on

January 23 of a motion for extension of time for Mr. Goldstein's Bankruptcy Trustee, John P. Barbee (the "Trustee") to file responses to Plaintiffs' pending Motion for Summary Judgment against Jamie Goldstein on or before March 10, 2006. Counsel for Mr. Goldstein was informed that counsel for Plaintiffs was out the office and unavailable.

Since filing the Fourth Motion, counsel for Mr. Goldstein has conferred with

counsel for Plaintiffs, who stated that Plaintiffs are not opposed to a further extension of time to respond to the Motion for Summary Judgment until March 10, 2006. WHEREFORE, Plaintiff requests that the Court extend the deadline to respond to Plaintiffs' Motion for Summary Judgment until March 10, 2006 and that Court grant such other relief as is just and equitable.
