STATEMENT OF REASONS
The court makes the following findings concerning the objections to the presentence report: A Criminal History Category of III does not over-represent the seriousness of the defendant's criminal history or the likelihood that he will engage in further criminal activity. The court determines that no ruling is necessary concerning the remaining objections, because the controverted matters were not considered in imposing sentence or would not affect the sentence. Neither the government nor the defendant has challenged any other aspect of the presentence report. Therefore, the remaining factual statements and guideline applications are adopted without objection as the court's findings of fact concerning sentencing. Guideline Range Determined by the Court: Total Offense Level: 32 Criminal History Category: III Imprisonment Range: 151 to 180 months Supervised Release Term: 5 years on count one 2 to 3 years on counts two, three and four Fine Range: $17,50 0 to $4,000,000

The fine is waived because of the defendant's inability to pay. Total Amount of Restitution: None.

The sentence departs from the guideline range upon motion of the government, as a result of the defendant's substantial assistance.
