Defendant. ______________________________________________________________________________ MOTION TO CORRECT SENTENCE PURSUANT TO FED.R.CRIM.P. 35(a) ______________________________________________________________________________ Defendant, Robert Earl Charlton, by counsel, moves the Court pursuant to Fed.R.Crim.P. 35(a) to correct the "Judgment in a Criminal Case (For Revocation of Supervised Release)" (Doc. #59) filed December 21, 2007, on the following grounds: 1. The Court conducted a supervised release violation hearing on December 13, 2007.

Mr. Charlton admitted guilt to violations 1 through 7, as alleged in the petition on supervised release. 2. The Court imposed a sentence to a term of imprisonment of 9 months, with 64 days

credit for time served, and remanded Mr. Charlton to the custody of the United States Marshal. The Court did not impose a fine. 3. The judgment order (Doc. #59) states on page 7 of 7 that the defendant must pay a

fine in the amount of $100.00 on Counts 1 through 7.

Under Fed.R.Crim.P. 35(a), a court may correct a sentence that resulted from

arithmetical, technical, or other clear error within seven days after sentencing. This motion is made within four days from the date of the judgment order and is therefore timely. 5. Mr. Charlton respectfully requests the Court correct the above-stated error in the
