BOBBY FRANK MATA, Defendant. ______________________________________________________________________ ORDER ______________________________________________________________________ THIS MATTER having come before the Court on Defendant's Motion for Modification of Term of Imprisonment Pursuant to Title 18 U.S.C.S. §§ 3582(c)(2); 3553 and Sentencing Guidelines Manual § 5H1.4 (Doc 150 - filed June 17, 2008) and the Government's Response thereto (Doc 157 - filed July 2, 2008), and the Court being fully advised in the premises, the Court finds that this amendment is not applicable to the defendant's case, because the defendant's case did not involve cocaine base. The Court's review of the record reveals that on May 16, 2002, the defendant was sentenced to 157 months in custody after pleading guilty to possession with intent to distribute 500 grams or more of methamphetamine.
