DUTY TO AVOID UNNIECRSSARV COST OF SERVICIC ()F SUMMONS
Rule 4 ofthe Federal Rules ol`Civil Procedure requires certain parties to cooperate in saving
unnecessary cost ofscrvicc ofthe summons attd the complaint. A tlcfetttlant located iu the
United States, who, aI`ter being notified of an action attd asked to waive service ofsutmnons
on behalf of a plaiittifflocatcd in tlte US, fails to do so will be required to hear the cost of
suclt service unless good cause he sltown for that deI'endant's failure to sign and return the
waiver.
lt is not good cause for a failure to waive service that a party believes that the complaint is
unfounded, or that the action has been brought in an improper place or in a court that lacks
jurisdiction over the subject matter ot`the action or over defendants person or property. A
dctcndant who waives service of summons retains all defenses and objections, except any
relating to the summons or the service of summons, and may later object to thc jurisdiction ofthe
C`ottrl or to the place to where the action has been brought.
A defendant who waives service must witltin the titne specitied on the "Rcturn ot` Waiver"
form served on plaintiff, iftinrepresented or on plaintiffs attorney, a response to the (Yontplaint
and must also tile a signed copy ofthe response with the Court. lfthc answer or a motiott is not
served within this time, a defaultjudgement may be taken against that defendant. By waiving
service, a defendant is allowed more time to answer than ifthe sttmmons had been aettially
served when the reqttest for waiver of service was received.
