GOVERNMENT'S RESPONSE TO DEFENDANT CRAIG STEPHEN HUDDY'S MOTION TO TERMINATE CURRENT SUPERVISED RELEASE

The United States of America, by and through Assistant United States Attorney Thomas M. O'Rourke, submits the following response to the Motion to Terminate Current Supervised Release (document 266), which the defendant Craig Stephen Huddy filed on April 4, 2007. 1. The defendant pleaded guilty to 41 counts of mail fraud, wire fraud and money laundering. The court sentenced him to a term of imprisonment of 60 months and a three-year term of supervised release and ordered him to pay restitution in the amount of $365,145.00. The defendant's term of supervised release commenced on April 20, 2006. 2. The government objects to the present motion for early termination of the term of supervised release for the following reasons: a. The governing statute says a court may terminate a term of supervised release only when "warranted by the conduct of the defendant released and the interest

of justice." 18 U.S.C. ยง 3583(e)(1). The defendant cited no extraordinary reasons for early termination. He merely asserted that he served his prison sentence and has complied with the conditions of supervised release. b. The defendant has not completed the payment of restitution.
