Defendant was previously sentenced in this case on October 17, 2001, and as part thereof was sentenced to three years of supervised release. 2. On March 9, 2005, Defendant was again convicted of illegal reentry into the United States (Criminal Case No. 05-cr-00090-MSK), based on his admission that he had illegally reentered the United States. A Petition for Violation of Supervised Release was filed on February 24, 2005. 3. Defendant was sentenced in Criminal Case No. 05-cr-00090-MSK on December 12, 2005, and it is now appropriate for the Court to take up the matter of the pending supervised release violation petition. WHEREFORE, the United States requests that the Court schedule a hearing on the pending Petition for Supervised Release.
