NOTICE OF PLAINTIFFS' LIMINE ISSUES
Pursuant to the Court's June 4, 2007 verbal order and the June 5, 2007 Order (Doc. # 516), Plaintiffs Charles M. Kovacs, Christine H. Bukala, Danny M. Trammell, Robert C. McGrath and Joseph J. Ragusa submit the following list of proposed motions in limine for prescreening by the Court at the status conference scheduled for June 18, 2007, at 10:30 a.m.: 1. Whether Defendant The Hershey Company (Hershey) should be allowed to
present evidence or argument concerning "Defenses" 5, 13, 14 and 15 Hershey raised for the first time in these proceedings in the Final Pretrial Order, Doc. # 371, pp. 9 - 11;[1]
The issues summarized in these Paragraphs 1 through 4 were previously briefed by the parties in July and August 2006, within Plaintiffs' Motion in Limine, Doc. # 383, Defendant's Response to Plaintiffs' Motion in Limine, Doc. # 405, and Plaintiffs Reply Re: Their Motion in Limine (filed under seal).

Whether Hershey should be allowed to present any evidence or argument
in alleged support of "Defense" 13, Doc. # 371, p. 11, since it is not a recognized defense to an ADEA claim; 3. Whether Hershey should be allowed to present any evidence or argument
surrounding the false, irrelevant and prejudicial allegation of counsels' solicitation of the Plaintiffs; 4. Whether Hershey should be allowed to present any evidence or argument
regarding the amounts Plaintiffs received under the 2003 early retirement program; 5. Whether Hershey should be allowed to present any evidence or argument
that it purportedly offered Plaintiffs McGrath and/or Bukala employment positions during the 2003 realignment; and 6. Whether Hershey should be allowed to present any argument or evidence
regarding allegations of historical poor performance by Plaintiffs, when poor performance is not an asserted basis for any employment decision by Hershey in this litigation. Further, Plaintiffs will request that the Court formalize its bar on Hershey presenting any evidence or argument regarding legal advice it relied on during the 2003 realignment and early retirement plan.
