Liberty Mut. Fire Ins. Co., D.Colo. 05cv01891. The Tenth Circuit Court of Appeals held that on remand the district court "should first inquire into the present status of Plaintiff's district court action against Liberty Mutual Fire Insurance Company. Resolution of that action could render moot the seminal question of whether Plaintiff's action against American Bankers is ripe." Warren v. Liberty Mut. Fire Ins. Co., ___ F.3d ___, 2007 WL 3151884, at *5 (10th Cir. (Colo.)).
