THIS MATTER, coming before the Court upon Plaintiff A Major Difference, Inc.'s Motion In Limine to Preclude Argument and Evidence Relating to Infringement Based on the Doctrine of Equivalents, and the Court being hereby advised in the premises: IT IS HEREBY ORDERED that Plaintiff's Motion is GRANTED. Defendants Erchonia Medical, Inc., Erchonia Medical Lasers, L.L.C., and Erchonia Patent Holdings, L.L.C. are precluded from asserting any argument or introducing any evidence at trial related to a claim of infringement of the '473 Patent under the doctrine of equivalents.
