JOINT MOTION FOR ENTRY OF STIPULATED PROTECTIVE ORDER
Plaintiffs , Estate of April Hill et al. through their attorney, Robert Carey,
Defendant Merastar Insurance Company, through its attorneys , Dorsey & Whitney LLP
Defendant Prudential Insurance Company of America , through its attorneys Campbell
Latiolais & Ruebel , P.

, and Defendant Allstate Insurance Company, through its

attorneys Wheeler Trigg Kennedy LLP, (hereinafter collectively referred to as the

Parties ) jointly move this Court pursuant to Rule 26(c) of the Federal Rules of Civil
Procedure to enter the attached Stipulated Protective Order concerning the treatment of
confidential information in this litigation , and as grounds therefor , state as follows:

Certain documents and information that Defendants will produce pursuant

to Rules 26(a), 33, and/or 34 of the Federal Rules of Civil Procedure contain trade

secret , or confidential research , development , or commercial information as defined in

Federal Rule of Civil Procedure 26(c)(7) (hereinafter " Confidential

Information

). The

Confidential Information of the respective defendants may be discussed at depositions

to be taken in this case. The Parties agree that the disclosure of any such Confidential
Information outside of this litigation could result in significant injury to the defendants

respective legitimate business interests.
The Parties have agreed not to disclose Confidential Information produced in this litigation to unauthorized individuals and have agreed not to use such

Confidential Information for purposes other than this litigation. The Parties request that
the Court confirm this agreement by entry of the attached Stipulated Protective Order
pursuant to Federal Rule of Civil Procedure 26(c).

Rule 26(c)(7) authorizes the Court to enter an order requiring the Parties

to preserve the confidentiality of information produced in discovery and restricting the

use of such information to purposes directly related to this litigation. The Tenth Circuit
and this Court have acknowledged that blanket protective orders, such as the Stipulated
Protective Order proffered by the Parties , are appropriate.
