The Named Defendants submit herewith a proposed joint witness list for the trial on arbitrability set for November 9-10, 2005. The Named Defendants note that pursuant to t C ut practice standards, h ors e ' approximately 6 hours of trial time are available per day for presentation of evidence, objections, argument, and motions. The Named Defendants have proposed to plaintiffs, subject to the C ut apoa t th parties divide the available time for all direct and cross examinations, ors prvl h t ' ,a e opening and closing. This is the approach the Court adopted at the March 8, 2005 hearing.

The Named Defendants have taken the proposed 6 hours and allocated that time for their direct and cross examinations, as shown below. The Named Defendants recognize that they will need to make accommodations within this allotted time for opening, closing, and other matters. The Named Defendants also recognize that the Court may allocate less than six hours to their presentation. These defendants will adjust the witness allocations accordingly.
