undertaking an obligation, outside of the discovery rules, to provide a further written description of its trade secrets before defendants provide their disclosures and discovery responses. 3. In cusl d cs o cne i t scope of P l oks one s i us n ocr n h ' s i ng e o R c'trade secrets, PolyRock' y s counsel pointed out (by way of example) that the trade secrets claimed include the combination of steps constituting P l oks o R c' manufacturing process as well as certain steps in that process, y such as P l oks o R c' method of coloring its products. As defendants acknowledge, counsel also y i n f dP l okst d sc t a i u a i l i por t ybs es eoo i ad d ti o R c' r e er s ts e s n u n rpia ui s cnm c n e ie y a e s cd g er n , financial information. PolyRock did not (and need not) take a factual position concerning the extent to which its trade secrets may be embodied in its issued patent (U.S. Patent No. 6,607,683) in order for defendants to provide discovery responses.
