Plaintiffs' counsel conferred with counsel for Defendant pursuant to D.C.Colo.LCiv.R. 7.1(A). Plaintiffs are authorized to state Defendant does not oppose dismissal, but opposes each party pay its own costs and fees. 2. Plaintiffs' complaint contains claims against Defendant for Bad Faith Breach of Contract and Civil Conspiracy. 3. Although both causes of action represent legitimate claims, Plaintiffs have made a business decision to no longer pursue the claims in an effort to streamline trial and maximize efficiency.

WHEREFORE, Plaintiffs request the Court dismiss Plaintiffs' claims for Bad Faith Breach of Contract and Civil Conspiracy without prejudice, each side to be responsible for its own fees and costs, and for any other and further relief the Court deems just and proper.
