DIRECTIONS F R USING THIS FORM O This form requires multiple distribution, service and filing. The responsibilities o f each party and the court reporter are described below.
1. APPELLANT Whether o r not a transcript is ordered, appellant or his counsel must complete Part I and Part I o f this form. Upon completion, appel lant must serve a copy on: I a. the Court Reporter (if a transcript is ordered), b. a l l parties, c. the Clerk o f the U.S. District Court, and d. the Clerk o f the U.S. court o f Appeals.

If a transcript is ordered, the appellant must obtain execution o f this form by the court reporter(s) who recorded the proceedings. Within the ten day period allowed f o r ordering the transcript under Fed. R. App. P. IO(b)(l), appellant must make adequate arrangements f o r payment f o r the transcript. The Court Reporter nay require a deposit equal t o the f u l l estimated cost o f the transcript. 28 U.S.C. §753(f).
Unless the entire transcript is ordered, appel lant sha ll serve on a l l appel lees a statement o f the issues he intends to present on appeal. Fed. R. App. P. 10(b)(3). The Docketing Statement required by 10th Cir. R. 3.4 f u l f i l Is this requirement. Those portions o f the transcripts that are filed that are pertinent to the appeal must be included in appel lant's appendix or, in cases where counsel is appointed, designated f o r inclusion in the record on appeal. 10th Cir. R. 10.2.2, I O.3.2(d) and 30.1.1. 2. APPELLEE Unless the entire transcript is ordered, appel lee may, within twenty days o f filing o f the notice o f appea I, fil e and serve on appel lant a designation o f additional transcript t o be included. If, within ten days, appel lant does not order and pay f o r the transcript so designated, appellee may, within a further ten days, order and pay f o r the transcript or move in the district court f o r an order compel ling appellant t o do so. Fed. R. App. P. 1 O(b)(3). 3. COURT REPORTER After receipt o f this form and after satisfactory financial arrangements have been made. The court reporter shall certify the date the transcript was ordered and estimate the date it w i l l be completed. The estimated completion date must comply with the Tenth Circuit Judicial Council's mandated district court Court Reporter Management Plans. Transcripts in a criminal case (includes 28 U.S.C. §92241, 2254, 2255) shal l be filed within 3 0 days o f the date arrangements f o r payment are made. Transcripts in a civil case shal l be filed within 60 days o f the date arrangements f o r payment are made. Court Reporters are subject t o a mandatory fee reduction if transcripts are not timely filed. See Appel late Transcript Management Plan f o r the Tenth Circuit, 10th Cir. R., App. B. The completed form must be served on: a. the Clerk o f the District Court and b. the Clerk o f the Court o f Appeals.
