Nearly four months have passed since this Court'Order and plaintiff has not proceeded s to arbitration. T DR C V s nweg,laintiff has made no effort to re-institute his earlier o IE T 'ko l ep d arbitration proceedings with DIRECTV and has taken no other steps to proceed to arbitration. In light of plaintiff's failure to undertake arbitration proceedings in accordance with this Court's Order, it appears that plaintiff does not intend to pursue his claims in the manner required. Accordingly, DIRECTV requests the Court to dismiss plaintiff's action sua sponte for failure to prosecute or, alternatively, to temporarily lift the pending stay for the sole purpose of permitting DIRECTV to move to dismiss for failure to prosecute and/or for other appropriate relief.
