JOSE ALFREDO ZAPATA, et al, Defendants. ________________________________________________________________________ MOTION TO ALLOW IF NECESSARY SUBSTITUTION OF COUNSEL AT PRETRIAL CONFERENCE ON MAY 12TH, 2006 ________________________________________________________________________ Comes now Defendant Jose Alfredo Zapata, through counsel, Richard J. Banta, and, pursuant to Rule 47, Fed. R. Cr. P, respectfully moves the Court for an Order granting this Motion. In support of such Motion, Defendant states the following: 1. A pretrial conference is scheduled in this case for Friday, May 12th, 2006 at 3:00 pm. 2. Defendant has waived his presence at such conference. 3. Counsel for Defendant is trial counsel in the criminal case of People v. Lell, case No. 05-CR-05435, currently pending in Denver District Court before Judge Herbert Stern. 4. In the Lell case counsel filed a pretrial motion requesting that the case be adjourned the afternoon of Friday, May 12, 2006 to allow counsel to attend the pretrial conference in this case.

5. Judge Stern was prepared to do so, however, the case was tried much quicker than anticipated and submitted to the jury the afternoon of Thursday, May 11th, 2006. 6. The jury is now deliberating the question of Mr. Lell's guilt or innocence. 7. It is, of course, impossible to determine when the jury will return a verdict, but if it is during the afternoon hours of Friday, May 12th, 2006 Judge Stern does not want to make the jury hold over until Monday to return its verdict. 8. The return of the jury verdict is a critical phase of the case, and requires counsel to be present. 9. Counsel has discussed this matter with Martha Eskessen, and she is willing to substitute if necessary at the pretrial conference for Mr. Banta, Wherefore, Defendant Zapata respectfully prays that the Court enter an Order granting this Motion, and granting such further relief as the court deems just and proper.
