JOSE ALFREDO ZAPATA, et al, Defendants. ________________________________________________________________________ MOTION TO ALLLOW TESTIMONY BY PHONE ________________________________________________________________________ Comes now Defendant Jose Alfredo Zapata, through counsel, Richard J. Banta, and, pursuant to Rule 47, Fed. R. Cr. P, respectfully moves the Court for an Order granting this Motion. In support of such Motion, Defendant states the following: 1. This matter has been set for a hearing on March 17th 2006 at 10:00 am on Defendant's Renewed Motion for Bond. 2. Defendant intends to call as a witness at such hearing Ms. Sandra Salteres, an immigration attorney who prepared the affidavit in support of Defendant's renewed motion. 3. Ms. Salteres resides in Boulder, Colorado, and is scheduled to undergo out patient treatment for a minor medical matter on Thursday, March 16, 2006. 4. She is uncertain as to whether she will be fully recuperated by Friday, and in any event will be unable to drive on the 17th.

5. Ms. Salteres's testimony at the hearing will track the information she has already provided to the Court and the government in her affidavit. 6. Ms. Salteres believes she will be able to appear by phone at the hearing, although there is a small chance that there may be some lingering after effects from the Thursday medical procedure. 7. Ms. Salteres is scheduled to leave for a two week vacation on Saturday the 18th , so the window of opportunity to have her available to testify at a bond hearing in the near future is very small. 8. Counsel for Mr. Zapata has not as of 4:00 pm on Monday, March 13th 2006 had an opportunity to discuss this motion with either Assistant US Attorney Stephanie Podalak or Guy Till, although he has left a voice message relaying the substance of this motion. 9. Defendant requests that Ms. Salatres be permitted to appear by phone at the hearing on March 17th, 2006. Wherefore, Defendant Zapata respectfully prays that the Court enter an Order granting this Motion, and granting such further relief as the court deems just and proper.
