Interpreters sworn Appearances Court's comments Defendant 1. Carlos Zapata-Hernandez' counsel, Mr. Tegmeier, is not present. Court's further comments Mr. Pagliuca's comments concerning motions to be filed. Mr. Pagliuca estimates they will need 30 days to file wiretap motions. Court's further comments Discussion re wiretap suppression motions ORDERED: Defendant Jaime Armendariz's oral motion to join in the June 30, 2005 stipulation concerning the Government's James proffer and Rule 801(d)(2)(E) statements is GRANTED. ORDERED: Defendant Jose Alfredo Zapata is deemed joined in the June 30, 2005 stipulation unless notification otherwise to the Court within 10 days. ORDERED: The defendants shall cooperate in filing any motion to suppress wiretap evidence on or before January 6, 2006 and each defendant shall have until January 27, 2006 to supplement the motion with information or objections particular to him or her; the Government's response to any wiretap suppression motion and all supplements is due on or before March 3, 2006. ORDERED: A hearing on any wiretap suppression motion and all supplements is set Friday, April 7, 2006 at 9:00 a.m., for the morning. All defendants and counsel shall be present.

Court's further comments re trial The Court tells counsel he will be seating 18 jurors, which means that there are three additional peremptory challenges; and that they should start thinking about how they are going to coordinate the peremptory challenges among the defense.
