JP MORGAN CHASE BANK N.A.'S MOTION FOR WITHDRAWAL OF PETITION FOR ANCILLARY HEARING Interested Party, JPMorgan Chase Bank, N.A. ("Chase"), hereby moves the Court for an order withdrawing its Petition for Ancillary Hearing (the "Petition") in response to the Order of Forfeiture (the "Order") of real property located at 591 Breckenridge Drive, Broomfield, Colorado (the "Property"). As grounds for this Motion, Chase states as follows: 1. 2. Property. On October 12, 2005 this Court entered the Order, which included the Property. On December 16, 2005, Chase filed its Petition asserting its interest in the

On March 2, 2006, the United States filed its Notice of Release From Forfeiture

Only As To Real Property Located At 591 Breckenridge Drive, Broomfield, Colorado (the "Release"). The Release released any and all claims the United States has to the Property and stated that the United States is no longer seeking forfeiture of the Property. The United States also filed and recorded a Release of Lis Pendens in the real property records of Broomfield County, Colorado. 4. On March 3, 2006, this Court entered its Final Order of Forfeiture and Judgment

As to Defendants' Interest Only finding, among other things, that the United States released the Property from the forfeiture proceedings. 5. Accordingly, in light of the United States' Release, Chase's Petition is now moot.
