Defendant Michael Smith, through his court appointed attorney Richard N. Stuckey, respectfully gives notice to the Court and all parties of record of a conflict between the hearing now scheduled in this case on February 1, 2008, for all day, and a Motion Hearing scheduled on January 25, 2008, in United States v. Orozco, et al., Case No. 07-cr-00275-EWN, for the same date, February 1, 2008, from 11 a.m. to 11:30 a.m. Attorneys Peter Bornstein, Thomas Goodreid, Ronald Gainor and the undersigned are all involved in the matter before Chief Judge Nottingham, and would respectfully request that this Court recess at about 11 a.m. on February 1, 2008, and resume when convenient with the Court after 11:30 a.m., so that they might attend the hearing in 07-cr-00275-EWN.
