Smith, and respectfully requests this Court enter an order allowing the Defendant to join in the co-Defendant Norman Schmidt's motion and amended motion to dismiss. As grounds therefore, the Defendant would state as follows: 1. The issues which are raised in the co-Defendant Norman Schmidt's motion to

dismiss and amended motion to dismiss the second superseding indictment are issues which equally apply to the Defendant Jannice McLain Schmidt. 2. Allowing this Defendant to join in the co-Defendant Norman Schmidt's motion

and amended motion to dismiss will allow a more efficient use of time, not only by counsel for the Defendant Jannice McLain Schmidt, but also for the Court. The Defendant Jannice McLain Schmidt respectfully requests that she be allowed to join in the co-Defendant Norman Schmidt's motion and amended motion to dismiss the second superseding indictment.
