Ray, and pursuant to REB Cr. Practice Standard V.D.1., moves this Honorable Court for permission to file a Sentencing Hearing Memorandum in anticipation of the hearing on resentencing of Ms. Schmidt, presently set for Friday, October 19, 2007, at 1:30 p.m. Counsel for defendant believes that the record that was made prior to Ms. Schmidt's previous sentencing should be supplemented with the appropriate case law and defendant's theory of the case on resentencing. This supplemental pleading will better able this Court to determine the issues prior to resentencing.
