Comes now the Defendant, Charles Franklin Lewis, by and through undersigned counsel, Ronald Gainor, who submits this Motion for Permission to be Excused From Conference Call and, in support, would state the following; 1. This matter is currently set for a telephonic conference call on October 25, 2007 at

10:00 a.m. 2. Undersigned counsel will be traveling out of the jurisdiction that day and will be

unavailable at the time the conference call is scheduled to begin.

Based on these circumstances, counsel would request that he be excused from the

hearing and be allowed to have his co-counsel, Tom Goodreid, stand-in for him before the Court. Wherefore, based on the above and foregoing, undersigned counsel for the Defendant, Charles Franklin Lewis, respectfully requests that this Honorable Court grant this motion and excuse counsel from attending the conference call and allow co-counsel, Tom Goodreid to stand-in for him before this Honorable Court.
