IT IS HEREBY STIPULATED AND AGREED by and between the parties that all claims which were or could have been asserted by the Plaintiff Leprino Foods Company ("Leprino"), against Defendants Big-D Construction Corp ­ California, Big-D Construction Corp, Big-D Corporation, Big-D Capital Corp., and Federal Insurance Company (collectively "Big-D Defendants") and all Third-Party claims by or against Marelich Mechanical Co., Inc. d/b/a University Marelich Mechanical ("UMM") and all counterclaims which were or could have been asserted by Big-D Defendants against Leprino, shall be dismissed with prejudice, subject to the parties' Confidential Settlement Agreement and Mutual Releases dated April 3, 2006; that the cause of action of each party shall be dismissed with prejudice; and that each party shall pay its own attorneys fees and costs.
