The parties are continuing to meet and confer on each of the various sets of instructions, some of which are governed by federal and/or Colorado, and others of which are governed by California law. The purpose of the continuing meet and confer process is to identify those instructions that may be duplicative, which can further clarified for assistance of the jury, which can be combined to satisfy both Colorado and California law, which can deleted based on further stipulation or agreement as to the parties'underlying claims, and which may have to be further modified to conform to the evidence expected to be presented at trial. Each of the parties reserves its rights to object, or to otherwise add, modify, or delete from the attached sets of instructions and proposed verdict forms during the continuing meet and confer process or at the time of trial, and as may be necessitated by rulings on pending pretrial motions.
