Pursuant to and in accordance with the Order entered on January 3, 2006, by Judge Walker D. Miller, which is incorporated herein by reference as if fully set forth, it is ORDERED that the Report and Recommendation of Magistrate Judge Michael J. Watanabe, issued November 22, 2005 is accepted. It is FURTHER ORDERED that plaintiff' claims against defendants Sandra Cannon-Grant s and Charles Abbott are dismissed.

issued February 1, 2007, is accepted. It is FURTHER ORDERED that the recommendation of Magistrate Judge Watanabe, issued February 22, 2007, is accepted. It is FURTHER ORDERED that the motion for summary judgment, filed by Defendants CMI, Kim Dempewolf, Marye Deming, and James Coolidge on June 12, 2006, is granted. It is FURTHER ORDERED that Plaintiff' Fourth Claim, asserting a violation of the s Eighth Amendment, is dismissed with prejudice as to all defendants. It is FURTHER ORDERED that all of Plaintiff' state law claims are dismissed s without prejudice. It is FURTHER ORDERED that judgment shall enter in favor of the Defendants and against the Plaintiff. FURTHER ORDERED that the complaint and cause of action are dismissed.
