As part of this agreement, Defendants Don Smith and Chris Thompson will not seek attorney fees and costs under 28 U.S.C. §1927, although the Court granted them leave to do so in its ruling on June 21, 2005. In addition, none of the defendants will seek costs in this matter. Therefore, all matters are concluded in this case as set forth in this Court's June 24, 2005, Order granting defendants' motions for summary judgment. Submitted this 14th day of July, 2005.
