KANE ORDERS In light of the confusion that has arisen with regard to the setting of a status conference in the wake of the Court' November 16, 2006 Memorandum Opinion and s Order on Plaintiffs'Athlete Claims, the Court wishes to CLARIFY that it was the setting of a status conference that was intended to take place within ten days, not the conference itself. Court' November 16 Memorandum Opinion and Order and confer regarding its portent s for the remaining claims and defenses so that a productive status conference could be had. At this point, the Court will simply set the status conference and, if such setting is not workable for either or both sides, the parties are instructed to confer regarding alternative dates and times and place a conference call to chambers to reschedule. Accordingly, A STATUS CONFERENCE is set in the above-captioned for Thursday, December 7, 2006 at 10:00 a.m. in Courtroom C-802 of the Alfred A. Arraj U.S. District Courthouse, 901 19th St., Denver, Colorado. The parties shall file a JOINT STATUS REPORT on or before Tuesday, December 5, 2006, suggesting a road map for the expeditious consideration and disposition of the remaining issues in these cases. The submission of a proposed revised Scheduling Order in 03-cv-1364 may be in order, as is a proposal for any further pretrial proceedings or trial on Shepherd' employment claims in 99-cv-2077. s These matters, as well as any others proposed by the parties in their Joint Status Report, will be addressed at the December 7 conference. ___________________________________________________ Dated November 21, 2006.
