Norris, through his attorneys, submits the following status report: 1. On August 23, 2005, Defendants Crowley and Ramirez filed a Notice of Appeal with the 10 Circuit Court of Appeals regarding Judge Walker Miller's July 26, 2005 Order concerning summary judgment.

2. On August 29, 2005, Magistrate Judge Boyd Boland issued an Order stating that the parties are to file a quarterly status report. 3. On September 12, 2005, the 10th Circuit Court of Appeals issued a show cause order to Appellants Crowley and Ramirez requesting that they sustain their burden of showing that the 10th Circuit has jurisdiction to resolve the issues on appeal. The show cause order set a briefing schedule. 4. On October 24, 2005, Appellants filed their Memorandum Brief regarding appellate jurisdiction with the 10th Circuit Court of Appeals. 5. On November 17, 2005, Appellee Jerry Norris filed his Response Brief with the 10th Circuit Court of Appeals. 6. The parties are awaiting a decision from the 10th Circuit Court of Appeals on the question of appellate jurisdiction. Respectfully submitted this 5th day of January, 2006.
