HEARING: TELEPHONIC DISCOVERY CONFERENCE Court in session: 3:32 p.m.

Court calls case. Appearance of counsel. Also on the conference call with Mr. Sostrin is Mr. Paul Drucker. Mr. Sostrin advises the Court as to Defendants' request to take the deposition of Manfred Enssle. Mr. Rogers notes the Plaintiffs opposition to the taking of the deposition. It is noted this case is set for Jury Trial January 09, 2006. It is ORDERED: The deposition of MANFRED ENSSLE shall go forward. Defendants shall have a limit of FOUR HOURS in which to depose Mr. Enssle. The deposition must be scheduled at a time that is mutually convenient for the deponent and counsel and shall be taken no later than January 05, 2006.
