The defendant Randy Overley, through his attorneys, Haddon, Morgan, Mueller, Jordan, Mackey & Foreman, P.C., moves for leave to file an Amended Motion to Alter or Amend the Judgment. The Amended Motion, which is conditionally filed herewith, adds two sentences to Paragraph 15. The two sentences provide relevant information bearing on the issues raised in the Amended Motion. WHEREFORE, Mr. Overley respectfully requests that this Court grant him leave to file the Amended Motion nunc pro tunc to October 3, 2005.
