NOTICE OF APPEAL

Trevor P. Jones, the Petitioner, through his counsel Andrew C. Heher, hereby gives notice that he appeals to the United States Court of Appeals for the 10th Circuit from this Court's Order, entered on April 20, 2006, and the final judgment entered on April 21, 2006, dismissing his petition for a writ of habeas corpus. Mr. Jones has contemporaneously filed with this notice a request for a certificate of appealability. In addition, Mr. Jones has been sent by undersigned counsel and Mr. Jones will return directly to this Court a motion and affidavit for leave to proceed in forma pauperis on appeal pursuant to 28 U.S.C. § 1915 and Fed.R.App.P. 24 in a habeas corpus action together with a certified statement of his inmate institutional account. WHEREFORE, Mr. Jones respectfully submits the herein Notice of Appeal.
