Defendants motion for stimmaryjudgment of noninfringement of U.S. Patent
No. 4,82l,l2l ("the ‘ i2l patent');
WI-IEREAG. the October 31, 2006 Order resolves Plaintift`s’ claims of
infringement against Defendants and Det`endants’ counterclaims for a declaration of
nonintringement ofthe ‘ l2] patent;
THEREFORE, THE COURT:
l. ADJUDGES AND DECLARES claims 7, 8, and 10-l 5 ofthe *12] patent
are not inlringedg
2. DISMISSL?5 with prejudice PlaintitFfs’ infringement claims against
Defendants;
3. DISMISSES without prejudice Defendants counterclaims for declaratory
judgment of invalidity and unenforceability as to all claims ofthe ‘l2l
patent.

4. OIUDERS that defendants may, no later than 60 days alter entry of this
judgment, or 60 days after either entry ofa mandate from the Court of

commence an action renewing its counterclaims in this action for
declaratoryjudgment ofinvalidity and unenforceability as to all claims of
the ‘121 patent, which action shall for all purposes be treated as a
continuation of this actio.n, including the right to seek costs and attorneys’
