Civil Action No. 03-cv-00623-WYD-PAC EVA LYONS, Plaintiff, v. RED ROOF INNS, INC., Defendant. JOINT STATUS REPORT

COMES NOW, Defendant, by and through its attorney, Frank D. Sledge of the law firm of White and Steele, P.C., and Plaintiff, Eva Lyons, pursuant to the Court's Order dated July 13, 2005, and submits this Joint Status Report, as requested by this Court. This matter comes before the Court on an Order and Judgment from the United States Court of Appeals for the Tenth Circuit which was filed on May 12, 2005. Pursuant to that Court's Order, the above-titled matter was "remanded in part for further proceedings." Specifically, the Court of Appeals concluded that the District Court erred in granting summary judgment in favor of Defendant Red Roof Inns, Inc. on Plaintiff's Claim for Gender Discrimination. At this time, Plaintiff, Eva Lyons, provides that she will be filing a Petition for Certiorari related to her claims for reverse racial discrimination and retaliation with the United States Supreme Court prior to her self-calendared deadline in late August. In conjunction with her Petition for Certiorari, Plaintiff also requests that her single claim for gender discrimination now proceed to trial. It is Defendant Red Roof Inns, Inc.'s position that this matter should be

stayed pending the determination to be rendered by the United States Supreme Court upon review of Plaintiff's Petition for Certiorari. In particular, it is Defendant's position that it will best serve the parties and the judicial economy to try any and all potential claims at the same time. This can only be done after Plaintiff has obtained her determination from the United States Supreme Court upon her Petition for Certiorari. Respectfully submitted this 27th day of July 2005.
